Welcome to Datsit ("Platform," "we," "us," or "our"). These Terms & Conditions ("Terms") govern your access to and use of the Datsit website, mobile application, and all related services. By accessing, browsing, or using Datsit, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not use our Platform.
Datsit is an online marketplace that connects guests seeking accommodation with hosts offering properties. We facilitate bookings but do not own or operate the properties, nor are we responsible for the performance of hosts or guests.
2. Use of Platform
2.1 Eligibility
You must be at least 18 years old and have the legal capacity to enter into binding agreements to use Datsit. By using the Platform, you represent that you meet these requirements.
2.2 Account Registration
To use certain features of Datsit, you must create an account. You agree to provide accurate, complete, and current information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to notify us immediately of any unauthorized use.
2.3 Prohibited Conduct
You agree not to use Datsit for any unlawful purposes or in violation of any applicable laws. Prohibited conduct includes but is not limited to: harassment, discrimination, fraud, publishing false information, attempting to gain unauthorized access, using automated tools to scrape data, or violating intellectual property rights.
3. User Responsibilities
3.1 Guest Responsibilities
As a guest, you agree to: treat the property and host's belongings with respect, follow house rules provided by the host, report any damages or issues immediately, respect the host's privacy and that of other guests, comply with all local laws and regulations, and conduct yourself in a professional and courteous manner.
3.2 Host Responsibilities
As a host, you agree to: provide accurate and complete property information, maintain the property in clean and safe condition, honor accepted bookings unless there are legitimate safety or legal concerns, respond to guest inquiries promptly, comply with all local rental laws and obtain necessary licenses, and not discriminate against guests based on protected characteristics.
3.3 Content Responsibility
You are solely responsible for any content you upload, including photos, descriptions, and reviews. You warrant that you own or have permission to use all content and that it does not violate any laws or infringe on third-party rights.
4. Booking & Cancellation Policies
4.1 Making a Booking
When you book a property, you enter into a direct agreement with the host. Your booking is confirmed upon payment. The booking price includes all fees, taxes, and service charges as displayed before checkout. Any special requests should be communicated to the host after booking confirmation.
4.2 Cancellation Policies
Each property has its own cancellation policy (Flexible, Moderate, or Strict) displayed before booking. Guests canceling within the allowed window receive refunds according to the policy. Hosts canceling without valid reasons may face penalties. In case of disputes regarding cancellations, Datsit's decision is final.
4.3 No-Show Policy
If a guest does not arrive on the check-in date without prior communication, the host may mark the booking as a no-show. No refunds are provided for no-shows. Guests should contact the host or Datsit support immediately if they cannot make their reservation.
5. Limitations of Liability
5.1 Disclaimer of Warranties: Datsit provides the Platform on an "as-is" basis without warranties of any kind, express or implied. We do not guarantee the accuracy, completeness, or reliability of content posted by users.
5.2 Limitation of Liability: To the maximum extent permitted by law, Datsit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data, even if we have been advised of the possibility of such damages.
5.3 User-to-User Transactions: Datsit is not responsible for disputes between guests and hosts. We facilitate transactions but do not endorse or guarantee the conduct of any user. Any legal claims should be resolved directly between the parties or through appropriate legal channels.
5.4 Third-Party Content: Datsit is not responsible for third-party websites, services, or content linked from our Platform. Your interactions with third parties are at your own risk.
6. Payment & Fees
All payments on Datsit are processed through our secure payment gateway. Guests pay the total amount including base price, taxes, and service fees. Hosts receive payment minus Datsit's commission (typically 8-12%). By making a payment, you authorize Datsit and our payment partners to charge your provided payment method. Refund timelines depend on your payment method and bank processing times.
7. Termination of Account
Datsit reserves the right to suspend or terminate any account that violates these Terms, engages in fraudulent activity, or poses a risk to other users or the Platform. Terminated users may not create new accounts. Upon termination, any pending bookings will be cancelled and appropriate refunds processed.
8. Modifications to Terms
Datsit may modify these Terms at any time. We will notify users of significant changes via email or an announcement on the Platform. Your continued use of Datsit after changes indicates your acceptance of the modified Terms. We recommend reviewing these Terms periodically for updates.
